Privacy Notice

What I collect, why I collect it, how I protect it, and the rights you have over it

  1. Who I Am

    This practice is run by Nicholas Scarcliffe from Dubai, United Arab Emirates. You can contact me about anything in this notice at [email protected] or on +971 58 882 2795.

  2. What I Collect

    When you contact me, I receive your name, your email address, and your message, whether you use a form on this website, email, WhatsApp, or the telephone. If you are a clinician or audiologist, the referral form also asks for your clinic or practice, your role, and your country.

    When you book a call or a session, I receive the details you enter in the booking calendar: your name, your email address, your time zone, any note you choose to add, and your telephone number if you ask me to call you.

    When we work together, I hold the details in your Client Agreement; a confidential coaching log of your name, your contact details, and the dates and length of our sessions; any brief notes I keep to support our work; recordings of sessions, and any transcripts made from them, if you agree to them; and your testimonial, if you agree to give one.

    When you sign up for my newsletter, I receive your email address. When you visit this website, my hosting provider processes basic technical information, such as your IP address and browser type, so that the site can be delivered securely.

  3. Information About Your Health

    Because of the nature of my work, you may tell me about your hearing or your health. This is sensitive information, and I treat it with particular care. I use it only to support our work together, I hold it only with your explicit consent, and I never share it without your permission except in the circumstances described under Confidentiality below. You never need to share more than you are comfortable sharing.

  4. Why I Use It, And On What Basis

    I use your information to reply to your enquiries, which is in our legitimate interests; to arrange and deliver sessions under our agreement, which is necessary to perform that agreement; to keep the records my professional body requires, which is in my legitimate interests and meets my professional obligations; to send my newsletter, with your consent, which you can withdraw at any time; to record sessions, with the consent you give at the start of each call; to share one recorded session for my ICF credential assessment, only with your written permission; and to publish your testimonial, with your written consent.

  5. The Services That Help Me

    I use a small number of trusted services to run the practice. Each handles information only to provide its service to me, under its own security and privacy terms: Google Workspace for email, calendar, and Google Meet video calls with live captions; Cal.com for bookings; Formspree for the forms on this website; Cloudflare for hosting and security; Google Fonts for the typefaces on this website; WhatsApp for messages, if you choose to use it; and PandaDoc for the electronic signature of the Client Agreement. I will update this list if that changes.

  6. Information Stored Outside Your Country

    Some of these services store information outside the country where you live, including in the United States and the European Union. Where that happens, I rely on the safeguards those providers offer, such as standard contractual clauses, so that your information remains protected to the standard the law requires.

  7. Confidentiality

    I never sell your information, and I never share it for anyone else’s marketing. What you share in sessions stays between us, except where I am required or permitted to act: a serious risk of harm to you or to someone else, a safeguarding concern involving a child or vulnerable person, or a legal obligation to disclose. If a clinician refers you to me, I report back to them only with your written consent.

  8. Session Recordings

    With your agreement, I may record a session. I ask at the start of every call and record only if you say yes, and your answer is captured at the start of the recording. You can ask me to stop recording at any time, and saying no never affects our work.

    Recordings allow me to reflect on and develop my practice as a coach and mentor, to recall accurately what we discussed, to prepare thoughtfully for our next session, and to keep the detailed records that help me serve you as effectively as possible.

    A recording is shared with no one, with one possible exception that needs your separate written permission: my ICF credential assessment, in which an ICF assessor or my mentor coach reviews a single session. If you agree, only first names are used, and you may listen to the recording first.

    Recordings, and any transcripts made from them, are stored securely in my Google Workspace account. You can ask for a copy, or ask me to delete one, at any time. I keep them while we work together and delete them within 90 days of our final session, unless you have given written permission for one to be kept for my ICF assessment.

  9. Teenagers

    I work with people aged 13 and over. For clients aged 13 to 17, a parent or legal guardian gives written consent before the first session, and parents are copied on every message. A session with a client under 18 is recorded only if both the client and a parent or guardian agree.

  10. How Long I Keep It

    If we do not go on to work together, I keep your enquiry for up to 12 months. I keep client records, including the Client Agreement and the coaching log, for up to six years after our last session to meet professional and legal requirements, and then delete them securely. I keep session recordings while we work together and delete them within 90 days of our final session, unless you have given written permission for one to be kept for my ICF credential assessment. I keep newsletter details until you unsubscribe, and testimonials until you withdraw your permission.

  11. How I Protect It

    I keep your information in secure, password-protected accounts, share it only with the services listed above, and keep no more than I need. No system is completely secure, but if a breach ever affected your information, I would tell you, and the relevant authority where the law requires it.

  12. Your Rights

    You can ask me at any time to see the information I hold about you, to correct it, to delete it, to restrict or object to how I use it, or to receive a copy in a portable format. Where I rely on your consent, you can withdraw it at any time. I will reply within one month. If I need to keep some records for professional or legal reasons, I will tell you which and why.

  13. Cookies

    This website does not use advertising or tracking cookies. Your browser remembers your choice of light or dark mode on your own device. The booking calendar on the Discovery Call and Book A Session pages is provided by Cal.com, which may use its own cookies so that booking works, and my hosting provider may use a strictly necessary cookie to keep the site secure.

  14. Complaints

    If you have a concern, please contact me first, and I will do my best to put it right. You also have the right to complain to the data protection authority where you live: in the United Arab Emirates, the UAE Data Office; in the United Kingdom, the Information Commissioner’s Office; and in the European Union, your national data protection authority.

  15. Changes To This Notice

    I may update this notice from time to time, and the version published here is the one in force. If a change affects how I use information you have already given me, I will tell you.
